Reservation
The completed reservation showing the names of all persons on whose behalf you are making a booking must be completed by the party leader. NON-REFUNDABLE deposit of $250 for each week booked is required at the time of booking. For bookings during holiday periods, deposit amounts may vary. Deposits are accepted as partial payment towards the total cost of the rental. On receipt by the La Casita on the Island of your completed reservation form and deposit, we will reserve your days. It is important to check the details on the quote and that all the dates are exactly as you requested. The La Casita on the Island responsibility is to provide you with the days you have booked as confirmed to you and subject to these booking conditions.
Security Deposit
A security deposit is required. A refundable $300 must be paid at time of reservation to ensure the owner has an option in the event of property damages or replacement of missing items. After guest departure, the Owner or Management Company determines that the property was not damaged and there are no missing items, the $300 will be reimbursed within 14 days after departure.
Paying the Balance
Balances are payable in full 60 days before check-in. For bookings within 60 days of check-in, the total rental amount is payable in full at the time of booking. If payment of the balance of the price of the reservation is not received by the La Casita on the Island by the due date, the La Casita on the Island reserves the right to cancel the booking in which case the La Casita on the Island is entitled to keep all deposits paid.
La Casita on the Island reserves the right to raise or lower its prices at any time before you book. Once you have booked and confirmation has been sent, the price of the reservation is guaranteed except that the La Casita on the Island may pass on to you, and you will have to pay, any tax, duty, levy or any increase in such tax, duty or levy that is charged by any government or other authority after the date your booking is confirmed and accepted. If the advertised price of the house is reduced below what you agreed to, your original price cannot be changed.
Maximum Occupancy
Unless otherwise approved by the Owner in writing, occupancy over the indicated capacity may result in the immediate removal of you and other members of your party from the La Casita on the Island and forfeiture of all amounts paid. The maximum occupancy of La Casita on the Island is 8 people. If during inspection, we find out that more than 8 people are staying in the house without prior notification, the Management Company and/or the Owners reserves the right to refuse admission or remove guests who do not follow our terms and conditions without any type of reimbursement.
Parties, Fiestas, and Large Gatherings Parties
Fiestas and large gatherings are not permitted at the La Casita on the Island under any circumstances. Conduct of unauthorized parties or gatherings may result in your removal from the property without refund and the Owner or Management Company may contact local law enforcement when appropriate. You agree to respect the La Casita on the Island, neighbors, the surrounding community and to follow all applicable laws, regulations, ordinances and rules, including noise ordinances. You agree to conduct yourself in a manner that does not disrupt neighbors or community members.
Code of Conduct
Emerald Island Resort is a premier community, and it is the guest's responsibility to ensure that all community rules are followed, and that guest's behavior does not inconvenience your neighbors in any way. The Emerald Island Resort community requires “quite hours” between 10:00 pm and 7:00 am. In the event of any disturbance, you may be requested to leave the property and forfeit all monies paid.
Condition of the Property
We care very much about La Casita on the Island and strives to keep it in excellent shape. If during your stay you notice any problems, hazardous conditions, housekeeping issues, or maintenance issues, please notify the Owner and the Management Company immediately.
Pets
Any type of pets, such as but not limited to, dogs, cats, bird, reptile are NOT allowed. If you plan to bring a service animal of any type, you must request approval from the property owner before you pay your deposit.
Smoking, Vaping, Illegal Drugs, and Illegal Activities
For the comfort of all guests, La Casita on the Island is a non-smoking and drug free facility. The use or possession of illegal drugs and/or illegal activity in the La Casita on the Island, pool, spa, deck, sidewalk, and driveway is prohibited. The owner or Management Company has the right to contact the legal authorities if suspect that such activities are taking place in La Casita on the Island. If authorities confirms or a visual inspection of Management Company or Owner confirm that such activities are taking place the Owner or Management Company reserves the right to remove guests without any type of reimbursement.
Arrival Details & Check in and Check out Time
Once your booking has been paid in full you will receive a confirmation email with additional information related to your stay. Check in time: 4 p.m. Check out time: 10 a.m.
Parking
Only 2 cars are allowed to park on the driveway of the La Casita on the Island. Parking on the street is available for a maximum of 2 cars per house. The Emerald Island Resort operate a system that involves parking on the even-numbered side of the road during even-numbered months and the odd-numbered side of the road during odd-numbered month. Example: January =Odd numbers, February = Even numbers. NO vehicles are allowed on any part of the grass area or landscaping. Avoid parking across the sidewalks. The Emerald Island Resort charge a nonrefundable one-time $20 access fee per vehicle that must be paid upon arrival at the Clubhouse.
Cancellation Policy:
All funds paid to La Casita on the Island are non-refundable unless stated otherwise and no refunds will be due in the event your stay at the La Casita on the Island becomes impossible for a reason outside the Owner or Property Management’s control, including natural disasters, fire, epidemic, pandemic, federal, state, or local quarantine, civil commotion, changes in laws or regulations, evacuation orders, or other acts of government agencies. However, in such circumstances, the Owner may choose, in its sole discretion and as your sole remedy, to issue a travel credit of the amounts paid to the Owner as an act of goodwill. Any travel credits issued by the Owner will be subject to the terms set forth at issuance, including terms regarding expiration date and non-transferability. For purposes of clarification, inclement, unfavorable, or even severe weather is not considered a force majeure event under this provision and no refund or credit is due (or will be made) to the Guest. A reservation of $250 per each week of booking is required. Any cancellation of a booking by the client must be in writing or by mail from the person who completed the booking form. Cancellation will be effective from the date it is received and acknowledged. You may cancel your booking at any time. Cancellation charges will apply as follows:
• Cancellation prior to 8 weeks of arrival: Deposit forfeited
• Cancellation between 6-8 weeks prior to arrival: 50% of the full fee will be forfeited
• Cancellation less than 6 weeks prior to arrival: 100% of the full fee will be forfeited
• Cancellation due to contracting an infectious disease, such as COVID, original copy of the test result must be provided by mail: 50% of the full fee will be forfeited or credit for a future reservation. Such credit is not transferable. The Owner reserves the right to cancel this Terms and Conditions at any time prior to the Guest arriving to La Casita on the Island. In such event, all payments made by the Guest to the Owner will be refunded. The Owner reserves the right to modify this Terms and Conditions at any time prior to Guest arriving to La Casita on the Island. In such event, the Guest will be notified of the changes. If the Guest do not agree to the modification and wish to cancel the cancellation charges will apply.
Method of payment
Payment can be made by check, cashier’s check, money order, or PayPal. We prefer payment by check, either personal, business or bank. We will accept payment by PayPal, however the processing fee of 4% must be paid by the renter. Balance is to be paid six weeks prior to arrival. Payment can be made by check, cashier’s check, money order or PayPal. Please note that, processing charge fees of 4% by PayPal, must be paid by the Guest. Personal check is accepted only where arrivals are greater than eight weeks. Payments should be addressed to the Property Owners: Maria and Ivan Rodriguez, and mail to: 11151 Valley View Dr. Box 903 Bristow VA 20136. If booking within six weeks or less than six weeks full payment is due immediately. Payment is to be made through PayPal. Please note that, the 4% processing charge fees by PayPal must be paid by the Guest.
Front Door Access Use the code provided to unlock the front door. Further detail will be provided at time of booking.
Changes by La Casita on the Island
All descriptions are made in good faith and every care is taken to ensure their accuracy and advertised facilities, amenities, entertainment and schedules may on occasion be restricted, curtailed, changed or cancelled. We will always try to advise you in advance of any changes before the rental begins but cannot accept any liability to changes by owners or management companies to advertised facilities for property or accommodation.
Damaged or Missing Items La Casita on the Island will be inspected after your departure. Any damaged or missing items will be identified. We will advise you of any costs that may arise as a result of the inspection. Any damages, breakages, accidents are to be reported to the Management Company immediately. Any missing items or damage will be charged against the security deposit.
Personal Property and Liability We strongly advise guests to take out insurance to cover any cancellation charges and the normal travel insurance cover in respect of illness, injury, acts of God, flight cancellation, volcanoes, hurricanes etc., as we the Owners and our Management Company take no responsibility for any of the above. The Management Company and/or the Owner do not accept liability for lost or stolen personal property of the Guest from the La Casita on the Island during the Rental Period. No guarantee or promise of security, even where the Guest makes use of any advice given. If property of the Guest is lost or stolen, the Guest should advise the Management Company, and the company will notify the appropriate authorities. The Management Company and/or the Owner do not accept liability for acts of violence, nature, fire, flood, war, civil disobedience, riot, or other force of mature that may have a deleterious effect on the Guest. In the event of such force of nature, the Management Company will try to assist the Guest in any way possible. The Owner or Management Company cannot accept liability for acts or omissions over which we have no control such as airlines, car hire companies, management companies and for loss or damage caused by Force Majeure events such as strikes, fire, flood, delays or any other events beyond our control. The La Casita on the Island or Management Company cannot accept any liability for injury to guests or visitors to the homes or by use of swimming pools or for loss or damage to personal property howsoever caused. Completion of the booking form constitutes acceptance of the terms and conditions on behalf of the party booked.
Pool / Spa Water Heating
If the guest elects to pay for Pool Water Heating, we will endeavor to ensure that the pool water temperature is maintained at a minimum of 80 degrees. However, this temperature CANNOT be guaranteed as the air temperature is a major factor in heating the pool water. Should the equipment used to heat the water fail in one way or another, we will do everything we can to correct the situation. If we can’t correct the problem, we will refund a fair portion of the price we have charged for the service. Barbeque Grill
We do not have an outside grill. They are not allowed by law to be used inside the screened pool deck area BUT some guests have done so (at other homes) and caused damage to the screen, home exterior and the white pool deck. You have a 4-burner electric stove with oven and a microwave oven above it. There are also some small appliances for toasting etc. There are numerous restaurants close by with excellent grilling items on the menu.
Bunk Bed
The Guest expressly acknowledges and agrees of the risk of use of bunk beds and agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law in Florida. The Guest hereby assumes full responsibility for and risk of bodily injury or death.
Indoor and Outdoor Maintenance
In case of need for repairs or general maintenance (swimming pool, garden, etc.) the Owner and Management Company has the right to enter the premises rented, both indoor and outdoor, accompanied by professional, trustworthy workmen. The Guest must absolutely ensure that children are not left alone in the house at any time. Neither are they to be allowed access to the pool or spa unless always accompanied by a responsible adult. The Guest must ensure that all access to the pool area is always closed. The Owners and the Management Company accept no liability regarding any personal incident occurring in the home or while using the pool or spa. Swim at your own risk always. The Owners and the Management Company are not always able to control all the components of the facility beyond our control and which we cannot accept liability. Florida is a tropical State with wildlife. The Owners and the Management Company are not liable for any result of wildlife injuries. Always stay alert.
Limited Short-Term Rental.
It is expressly understood and agreed that this is a short-term, transient vacation rental and is not a lease or other long-term residential tenancy agreement, and that the La Casita on the Island is not intended to be utilized as a primary residence. This Agreement is only for the licensed use of the La Casita on the Island for the stated reservation dates. It creates no property rights in you and no rights to renewal or for recurring usage. If you hold over after the expiration of your reservation dates, your extended stay, if authorized, will be from day-to-day only and will not constitute a renewal or an extension for any further term. In such case, you will be liable for paying for the additional day(s) at a rate equal to two (2) times the nightly rate set for the property on the dates of your holdover, plus the actual costs of re-accommodating future tenants that were scheduled to use La Casita on the Island during such dates. You cannot sublet the La Casita on the Island or any part of it and shall not assign any interest (in whole or in part) to this terms and conditions or any rights hereunder.
Assumption of Risk
The guest and anyone using the La Casita on the Island during your stay accepts and assumes all risks involved in or related to the use of the vacation rental and surrounding property, the pool, hot tub, or any other body of water (including but not limited to a lake or an ocean at or adjacent to the vacation rental), any water-related activities, features on the property, activities anticipated in during your stay on or off the property, amenities provided at the property, or third-party transportation vendors, as applicable, whether or not disclosed in the listing. The guest understands that travelling and staying in a vacation rental property may increase the likelihood of contracting an infectious disease, such as but not limited to covid-19, and you voluntarily assume that risk. The Guest further accept and assume all risks involved in or related to any recreational equipment of any kind, you are responsible for determining your fitness for participating in any features or activities during your stay and your ability to fully understand and comply with any directions, warnings, laws, or regulations presented. to the maximum extent permitted under applicable law, you knowingly, voluntarily and freely assume all risks, both known and unknown, of the above-described activities, and you assume full responsibility for participation in any such activities. ng.
